Any server you write may be licensed under your own terms (after all, you have to write it!). If you link to the baseserver, you may (using the Artistic license under my interpretation) still license it under your own terms. However, if you bundle AgNet with your server (rather than simply telling people where to go get it), you must provide AgNet source or offer to provide it, and keep these Copyright terms intact in the AgNet sources.
While it's good karma to provide your server under an open source license, you are under no obligation (even if you link to my baseserver). However, the easiest way to protect a server product of your own would be to simply not distribute it. Afterall, if you provide a server with a good service, you can just charge people for using it. Open Source isn't about not making money, it's about keeping software from becomming illegal to write.
To my knowledge, the only people who have actually tried to compile and test the code are Steven Newton and Robert Cope.
